Your Contracts Have an AI Gap. And It's Probably a Big One.

Most creator contracts were written before AI was part of everyday business. And they show it.

Quick gut check: does your contract say anything specific about AI? Not the generic intellectual property language. Something that actually addresses what a client or student can do with your work inside an AI tool.

If your agreement doesn't mention AI, the answer to all of this is technically yes: A client can run your deliverables through ChatGPT for "feedback." A student can upload your entire course workbook to an AI summarizer. Someone can use your headshot as input for a generative AI tool.

This is already happening. Your contracts almost certainly don't cover it.

A 5-Question Audit to Find the AI Gaps in Your Contracts Right Now

You don't need to rewrite your contracts from scratch. You just need to know where the gaps are. Then drop in the right language to close them.

Pull up your current service agreement or course terms and work through these five questions. Each one maps to a real AI clause that either exists in your contract or doesn't.

This week's audit

1. Can a client submit your deliverables to an AI tool for feedback or revision requests?

2. Can a student upload your course materials (videos, transcripts, workbooks) into any AI system?

3. Can someone join a live call you host with an AI notetaker running?

4. Can a client or organizer use your photos, recordings, or likeness as AI training inputs?

5. If you use AI in your own work, do your agreements disclose that?

If any answer is "I don't know" or "probably not covered," that is your gap.

I went through this exercise myself recently and found gaps I hadn't thought about, especially around AI notetakers on member calls.
